1. Overview

This website is operated by Wintercroft (“we”, “us”, “our”). By accessing our website or purchasing from us, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use our website or services.

Wintercroft provides digital download products (PDF templates) and, in some cases, physical products. These Terms apply to all purchases and use of our website, including downloadable digital content and physical items.

2. Orders, Pricing & Payment

  • All prices are listed in GBP unless otherwise stated and may change without notice.

  • Payment must be made in full at the time of purchase using approved payment methods.

  • By placing an order, you confirm that all information provided is accurate and complete.

  • We reserve the right to refuse or cancel any order, including where product descriptions or pricing are incorrect.

  • Unless stated otherwise, prices exclude taxes, shipping, and other applicable charges.

3. Digital Products (Downloads)

3.1 Product Description

Our digital products are downloadable files (typically PDF) containing templates and instructions to create physical items. You are responsible for:

  • Ensuring you have software to open and print PDF files

  • Printing and assembling the product correctly

  • Using appropriate materials for assembly

No physical items are provided unless explicitly stated.

3.2 Delivery & Access

  • Access to digital products is immediate after purchase via a download link.

  • Downloads are available for 365 days from the date of purchase.

  • Each product can be downloaded up to 3 times.

  • Technical issues with access should be reported to us promptly.

You are responsible for saving copies of your files; we do not guarantee indefinite access beyond the download period.

3.3 Consumer Rights & Refund Waiver

By purchasing digital content, you:

  • Consent to immediate delivery and performance of the contract

  • Acknowledge that your 14-day cancellation right under the Consumer Contracts Regulations 2013 is waived once download begins

Refunds are not available after the download has started, except where required by law. This consent is confirmed via a mandatory checkout checkbox.

4. Physical Products (Shipping, Delivery & Risk)

  • Physical products are shipped using tracked delivery where possible.

  • Delivery times are estimates and not guaranteed.

  • Risk of loss or damage passes to you upon delivery to you or a person you authorise to receive the goods.

  • You must provide accurate delivery information; we are not liable for failed deliveries due to incorrect details.

5. Returns, Refunds & Cancellations

5.1 Digital Products

  • Refunds are not available once the download begins, except where required by law.

  • Faulty digital products should be reported; we will work to provide a resolution.

5.2 Physical Products

  • Returns accepted within 30 days if items are unused and in original condition.

  • Custom-made items are non-refundable, unless faulty.

  • Faulty goods will be repaired, replaced, or refunded as per UK law.

5.3 Return Shipping

  • Customers are responsible for return shipping unless the item is faulty.

  • Tracked shipping is recommended.

6. Intellectual Property & Licence

6.1 Ownership

All designs, templates, artwork, branding, and content are owned by Wintercroft and protected under UK and international copyright laws.

6.2 Licence Grant

  • Purchase of digital products grants a limited, non-exclusive, non-transferable, revocable licence for personal, non-commercial use only.

  • Use of products is conditional on acceptance of these Terms.

6.3 Restrictions

You must not:

  • Share, distribute, or upload files publicly

  • Resell, sublicense, or transfer files

  • Use designs for commercial purposes or for profit in workshops, classes, or events

  • Sell or distribute physical items made using our designs

6.4 Enforcement

Breach may result in:

  • Immediate licence termination

  • Suspension of website access

  • Legal action for damages and enforcement of IP rights

7. Acceptable Use & Account Misuse

  • Do not use our website or products unlawfully or infringe IP rights.

  • Attempts to bypass download limits or security may result in account suspension.

We monitor for excessive downloads or suspicious activity and may restrict access to prevent abuse.

Fraudulent Activity

  • Orders using stolen payment methods or false information may be cancelled.

  • Suspected fraud may be reported to authorities.

8. Warranties & Disclaimers

  • Products and services are provided “as is” and “as available.”

  • We do not guarantee uninterrupted access or that products meet all expectations.

Skill & Assembly Disclaimer: Outcomes depend on user skill, materials, and printing accuracy. We are not responsible for user error.

User-Generated Results: Finished products may not match promotional images; results vary.

9. Limitation of Liability

  • Liability is limited to the maximum allowed by UK law.

  • We are not liable for indirect, incidental, or consequential losses.

  • Total liability is limited to the amount paid for the product.

These limits are subject to fairness under the Consumer Rights Act 2015.

10. Privacy & Data Protection

  • Personal data is processed per our Privacy Policy.

  • Data is collected to process orders, provide support, and improve services.

  • Payments are handled securely via Shopify.

  • You may request access, correction, or deletion of your personal data.

11. Third-Party Services

  • Hosted on Shopify; third-party providers may have separate terms.

  • We are not responsible for external websites or services.

12. Governing Law

  • These Terms are governed by the laws of England and Wales.

13. Dispute Resolution

  • Unresolved disputes fall under the jurisdiction of English courts.
